This research focuses on the analysis of the gender perspective in the jurisprudence of the Inter-American Court of Human Rights (IACHR), highlighting its role as a key body in the consolidation of international standards that promote substantive equality and combat structural discrimination against women and LGBTIQ+ people. Based on paradigmatic cases such as Campo Algodonero v. Mexico, I.V. v. Bolivia, and Vicky Hernández v. Honduras, systematic patterns of exclusion and violence are evident that the Court has managed to make visible and sanction through decisions with an intersectional approach. To this end, the specific objectives are: to examine the legal standards and interpretive criteria employed by the Inter-American Court of Human Rights in cases involving gender-based violence and discrimination based on sexual orientation or gender identity, and to determine how its jurisprudence has influenced the evolution of the Ecuadorian constitutional framework on equality and women's rights, through the constitutionality block. In conclusion, the research highlights how gender-based judgment is an essential legal tool for guaranteeing access to justice without stereotypes, harmonizing domestic law with international commitments, and building more equitable societies.
