Labor rights in the public sector: stability, competition and dismissal

This paper characterizes labor rights in the Ecuadorian public sector based on the parameters of job stability, merit-based competition, opposition, and dismissal. From a dogmatic and normative perspective, it analyzes how the State guarantees the protection of its employees and ensures institutional efficiency. Through a qualitative approach, supported by document review and analysis-synthesis, it examines specialized legal doctrine, current regulations, with an emphasis on the Constitution of the Republic and the Organic Law of the Public Service, and the jurisprudence of the Constitutional Court. It is concluded that labor rights in the public sector are protected by the guarantee of job stability, are acquired through merit-based and competitive selection as a path to permanent appointments, except in cases of popular election, and can only be terminated through the legal application of dismissal processes.
